Intellectual Property is Said to Be
Intellectual Property is said to be a form of creative endeavour protected
through a patent, copyright, industrial design, trademark, servicemark or
integrated
circuit topography. Such creative endeavors are said to be any new and
useful process, machine, composition of matter, life form, article of
manufacture, software algorithm, writing or tangible property. It is
said to include such things as new or improved devices, circuits, chemical
compounds, drugs, genetically engineered organisms, data sets, software
algorithms, writings, musical processes, and unique and innovative uses
of existing inventions.
Intellectual Property is said to be created when
something new and useful has been conceived or developed, or when unusual,
unexpected or non-obvious results, obtained with an existing invention,
can be practiced for some useful purpose. It is said to be created by one
or more individuals, each of whom, to be an inventor of the piece of
Intellectual Property, must have conceived of an essential element or
have contributed substantially to its conceptual development.
Intellectual Property Is
Intellectual Property is a crime against knowledge and thus a crime against
humanity. It's notion is an attempt to occlude knowledge for the benefit of
a few.
Suppose you were the one person able to discover a cure for cancer. Now
suppose the one remaining clue required for you to realize this cure was
claimed as the Intellectual Property of my company. What if we either
didn't offer this information for sale, or offered it at a cost prohibitive
rate. You would then die, quite likely of cancer, never having profered
the benefit of your unrealized insight upon humanity. Now, imagine that
someone very close to you is dying of cancer as you read. Get the picture?
The practice of Intellectual Property is analagous to restricting the
biodiversity of the rain forrest such that no two disimilar biological
materials could any longer freely interact. If this were done, the rain
forrest would become a comparatively impoverished system in short order.
Through the rediculously selfish notion of Intellectual Property, we are
similarly impoverishing the collective knowledge base of humanity. With
every copyright, patent and Non Disclosure Agreement, we diminish the
diversity of knowledge with which it is legally permissible to think.
Beneficiaries of Intellectual Property
If we ask ourselves who or what is the primary beneficiary of Intellectual
Property, it comes as no surprise that organizations, both public and
private, derive the greatest benefit from Intellectual Property laws?
By religiously aquiring and protecting Intellectual Property, they gain
ownership of a vast amount of that which barely even exists. In
so doing, they can control ideas for financial gain. Modern corporations
are largely Thought Merchants (TM) and the governments they fund are
largely their Idea Police (TM).
Combating Intellectual Property
It is ironic that the best means of resistance is often embrace; this
is the situation with Intellectual Property as well. If one extrapolates
the tenets of Intellectual property to their logical conclusion, it is
evident that an untenable situation will be the result.
If, as Intellectual Property proponents would have it, every Thing can be
property, then eventually there would be no Thing, tangible or intangible,
real or imagined, left free of lien and all Things possible would be
enlisted to compensate all other Things possible for use of their property.
It is not hard to imagine a near future based on a wireless,
Client/Seller (TM) architecture, where nanocents (TM) are transparently
exchanged for the consumption of all property, intellectual and tangible. When one
entered a lighted, heated building, for instance, a small, transdermal
chip could easily convey the individual's private key identity via
something like Bluetooth to the building's computers which would immediately
begin charging them for the benefit of light and heat received from the
building's owners, including appropriate portions necessary to cover
licensing fees required to deliver the technology being consumed. An
entire Nanotransaction (TM) Financual Food Chain (TM) could thus be
operating at all times between all enabled devices, both inorganic and
organic.
Far fetched as it may seem, such a scenario is quite likely in the near
future. All the technology for it exists today, and steps are being made,
probabably largely unconsciously, for it's realization.
In order to ensure that individuals are not enslaved at the bottom of
the Financual Food Chain (TM) of the modern world's growing
Client/Seller (TM) architecture, it will be necessary to corporatize
the individual. By corporatizing the self, one can begin to enjoy the
greater rights and diminished responsibility of a corporation. Self
Corporatization (TM) puts corporate law behind the individual, entitling
them to equal treatment with other corporations under the law. The
individual corporation can then publish price lists for goods and services,
charge for them and expect to be compensated for them when consumed by
other corporations. This would be realized in the above scenario, for
example, by the subdermal Client/Seller (TM) chip of the individual
entering the building simultaneously begining to charge for the heat
given off by the individual's body since their body heat reduces the
amount of
energy required to keep the building at a constant temperature of benefit
to all, thereby reducing the heating expense of the building's owner.
Intellectual Property Stasis
When individuals, through Self Corporitization (TM) and Self Ownership (TM),
begin
to gain an equal footing with corporations, by charging for their goods
and services consumed by other corporations just as they themselves are
charged, they will begin to be liberated from the Intellectual Property
Penury (TM) previously imposed upon them by foreign corporations. When
a critical mass of We the People (TM) become as large a source of product,
information, and service providers as we are now exclusively consumers,
the Intellectual Property system will lose it's teeth.
As the expression goes, what's good for the goose is good for the
gander, and Intellectual Property has been very good for the goose.
Perhaps it's time We the People (TM) took a gander.
